These are the rules for using the site. The important parts: event details come from organisers and public sources and can change, so check with the organiser before you go; we don't run, host or sell tickets to the events listed; anything you submit must be accurate and yours to share; anything paid for is clearly labelled; and if you're an organiser or venue listed here you can always ask us to correct or remove a listing.
1. Who we are, and agreeing to these terms
Under the Flight Path is an events newsletter and calendar for Sydney's Inner West, published at undertheflightpath.com.au by Sebastian Edwards (ABN 36 210 992 534), trading as Under the Flight Path ("we", "us", "our").
These Terms of Use apply whenever you use this site or the newsletter: browsing the calendar, subscribing, creating an account, submitting an event, or contacting us. If you don't accept them, please don't use the site.
Two other documents form part of these terms and you should read them:
- our Privacy Policy, which explains what we collect and what we publish
- our Disclaimer, which explains what a listing is and is not
Written notices to us can be sent to [email protected].
2. What this site is, and what it isn't
We gather what's on in the Inner West into one calendar and a weekly newsletter. Listings come from organisers' and venues' own public pages, from public event platforms and council calendars, and from people who submit events to us.
Being listed is free, and most listings are there simply because the event is on. We also offer paid promotion, such as featured placement, newsletter mentions and sponsorship. Anything that appears because someone paid us is clearly labelled as sponsored or promoted where it appears. Paying doesn't change whether an event is otherwise listed, and we don't accept payment to remove or bury anyone else's event.
We don't organise, host or run the events listed, and we don't sell tickets. We are not a party to any booking or ticket purchase between you and an organiser, venue or ticketing platform, and we take no part in disputes between you. See the Disclaimer.
3. Using the site
You may browse and search the calendar, and use what you find here to plan your own outings. You must not:
- scrape, harvest, crawl or bulk-copy the site or its contents, or use automated means to access it, except for search engines obeying our robots.txt and our published calendar feeds used as intended
- reproduce, republish or redistribute the calendar or newsletter as a competing listings service or dataset
- use contact details found here to send marketing, spam or unsolicited approaches
- interfere with the site's operation or security, probe it for vulnerabilities without our written permission, or attempt to access any account, data or admin area that isn't yours
- use the site for anything unlawful, or in a way that would put us in breach of the law
If you think you've found a security problem, please tell us at [email protected] rather than publishing it. We will not pursue you for a good-faith report.
4. Accounts and the newsletter
Accounts are optional and free. You must be at least 18 to create one, and it's for you alone: you sign in with a link we email you, so keep access to that email address secure and tell us if you think someone else is using your account. You can delete your account yourself at any time on your account page.
The "For you" picks are suggestions worked out automatically from the preferences you give us and, if you turn it on, what you open and save. They're a starting point, not a recommendation from us that any event suits you.
The newsletter is free, and you can unsubscribe at any time from the link in any issue. Referral rewards, where offered, are described on the Refer a friend page; we verify referrals before sending a reward, and we may change or end the programme, or withhold a reward where referrals look automated or fake.
5. Submitting an event
Anyone can submit an event. When you do, you promise us that all of the following are true:
- It's real and you're entitled to share it. You're the organiser, you work for them or the venue, or you're otherwise sharing details the organiser has made public.
- It's accurate. The dates, times, venue, price and description are true and current when you submit them, and you'll update them (with your manage link) or tell us if they change.
- It's open to the public. Anyone who meets the stated conditions, such as age limits or tickets, can go.
- It's lawful. The event, and what you say about it, doesn't break the law or promote anything unlawful, and doesn't make claims about anyone else that would damage their reputation.
- You have the rights. You own, or have permission to share, the text and any photo you upload, and they don't infringe anyone's copyright or other rights.
- It doesn't expose anyone. It doesn't include another person's personal information without their permission.
- Your details are real. The name and email address you give us are genuinely yours.
If you tell us you're the host, your business name, website and Instagram may be published with the event. Your name and email address are never published. This is set out in full in the Privacy Policy.
6. What we do with what you submit
Submitted events are reviewed before they're published, and we decide what to publish. We may:
- publish it, decline to publish it, or ask you a question before deciding
- edit it for length, clarity and our house style, and assign categories; we don't change the facts, and if something needs more than that we'll ask you
- draft a short description or categories with the help of an automated tool, from the details you gave us
- choose whether it appears in the newsletter or on social media, as well as the calendar
- remove it later, if it turns out to be inaccurate, cancelled, or in breach of these terms
We are not obliged to publish anything, and we do not have to give reasons for declining. We are also not obliged to keep anything published. You can ask us to remove an event you submitted at any time, using your manage link or by emailing [email protected] from the address you used.
7. The licence you give us
You keep ownership of what you submit. By submitting it, you give us a non-exclusive, royalty-free, worldwide licence to store, reproduce, publish, display, adapt for formatting and length, and communicate it (on this site, in our newsletter, in our calendar feeds, and on our social media accounts) for as long as we publish it.
The licence is limited to running and promoting Under the Flight Path. We don't sell your content on or licence it to third parties as a dataset. If we remove your event, or you ask us to, we stop publishing it; we may keep a record of what was published and when, for the reasons set out in the Privacy Policy.
8. If you're an organiser or venue listed here
You're probably listed because your event is public: most listings are compiled from your own website, ticketing pages, social media or council calendars, and some descriptions are drafted with the help of an automated tool from that public information. That means:
- You didn't have to ask to be listed, and listing is free.
- Details may be wrong or out of date. We re-check sources regularly, but events change faster than any calendar.
Getting it corrected
Email [email protected], or use your manage link if you submitted the event. We'll fix factual errors promptly. If you want a listing taken down entirely, ask and we will generally do it.
Paid promotion
If you buy promotion, what you're buying and what it costs will be agreed with you in writing before you pay, and that agreement takes priority over these terms where they differ. Promoted content is always labelled.
9. Our content and trade marks
The site's design, code, editorial copy, newsletter, blog posts, generated event cards and the compilation of the calendar as a whole belong to us or our licensors. "Under the Flight Path" is our brand.
You may link to any page here, and quote a short extract with attribution and a link. You may not copy the calendar or a substantial part of it, present our content as your own, or use our name or branding in a way that suggests we endorse you.
10. Disclaimers
Event details are provided for convenience and may change. Listing an event is not an endorsement by us of the event, the organiser or the venue.
We do not attend, inspect or vet events, and we don't check safety, accessibility, age suitability or licensing. The site is provided "as is": we don't promise it will be accurate, complete, current, uninterrupted or error-free. Our full position is set out in the Disclaimer, which forms part of these terms.
11. Liability
Your rights under the Australian Consumer Law come first. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If we supply you with services in a way that attracts a consumer guarantee, and that guarantee can be limited, our liability is limited to re-supplying the services or paying the cost of having them re-supplied.
Subject to that, and to the extent the law allows:
- we are not liable for any loss or damage arising from your use of this site or the newsletter, from anything published on them, or from any event you attend or ticket you buy through a link here
- we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, or loss of data
- our total liability to you for all claims connected with this site is limited to AUD $100
That cap reflects what this is: a free newsletter and calendar. It doesn't limit what we owe under a paid promotion agreement, which sets out its own terms.
12. Indemnity
If you submit content to this site, you indemnify us against any claim, loss, cost or liability we reasonably incur arising from that content being untrue, misleading, in breach of these terms, or in breach of someone else's rights, including a copyright claim over a photo you uploaded.
This doesn't apply to the extent the claim arises from our own changes to your content, our own editorial decisions, or our negligence. We'll tell you promptly if a claim is made, and we won't settle a claim you're indemnifying without consulting you first.
13. Suspension and removal
We may remove any content, close any account, or block access to the site, at any time, if we reasonably believe these terms have been breached, if we receive a complaint we consider well-founded, if content may be unlawful, or if we're required to.
Where it's practical and appropriate we'll tell you and give you a chance to respond first, but we may act immediately where the content may be unlawful or someone may be harmed.
14. Changes to these terms
We may update these terms. The current version is always at this address, with the date it was last updated at the top. If we make a change that materially affects your rights, we'll make that clear on the site. Continuing to use the site after a change means you accept the updated terms.
We may also change, suspend or discontinue any part of the site or the newsletter.
15. General
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply. If we don't enforce a right straight away, we don't lose it. You can't transfer your rights under these terms; we may transfer ours if we sell or restructure the business, and we'll tell you if we do.
These terms, together with the Privacy Policy and Disclaimer, are the whole agreement between us about your use of this site. Questions about these terms: [email protected].
